Introduction
The system of qualification described in this Technical Specification is intended to identify the capabilities
of an electrical installation contractor for work covered by CENELEC and in accordance with activities as
referred to in 8-2-1. It shall allow the relevant procurement entities to understand the profile of a
contractor and is a tool for assisting in making a decision when selecting a contractor for a specific
tender. It is not intended to cover the final selection process for specific contracts which takes place after
the qualification procedure.
1 Scope
This Technical Specification specifies the definitions, the criteria, and the application and assessment
procedures, as well as the respective documentation related to a system of qualification of electrical
installation contractors.
This qualification system includes electrical installation works including equipment supply. The
manufacturing process of such equipment is excluded from this system.
2 Normative references

3 Definitions
For the purposes of this Technical Specification the following definitions apply:
3.1
appeal committee
a committee which is responsible for the consideration of appeals against the decisions and the operation
of the qualification body
3.2
applicant
a physical person(s)/legal entity(ies), however organised, seeking to obtain/retain a qualification
certificate from a qualification body
3.3
certificate validity period
the period during which the qualification certificate is valid
3.4
competent body
a national private or public body recognising the competence and reliability of a qualification body
3.5
electrical installation contractor
a contractor having skills and experience to perform electrical installation works by whatever means
3.6
general contractor
a contractor who, in addition to carrying out the electrical works for which he is qualified, has the ability to
co-ordinate other qualified contractors to deliver part or all of a project.
A general contractor shall sublet works only to qualified contractors in the specific field of activity.

legal representative
a physical person who, according to national legislation, represents the applicant

4 Criteria for qualification bodies
4.1 General
This Clause 4 specifies the criteria that a qualification body shall fulfil in order to be recognised as
competent and reliable in the operation of a qualification system for electrical installation contractors. It
also specifies the procedures according to which the qualification body is recognised.
4.2 General requirements
4.2.1 The qualification body shall make its services accessible to all applicants. Access shall not be
conditional upon the size of the contractor or membership of any association or enrolment in a group, nor
shall qualification be conditional upon the number of contractors already qualified.
4.2.2 The procedures under which the qualification body operates shall be administered in a
transparent and non-discriminatory manner. The qualification body shall grant equal access to all
applicants. There shall not be any undue financial or other conditions.
4.3 Administrative structures
4.3.1 The administrative structure of the qualification body shall be such as to give confidence in its
qualification activities.
4.3.2 In particular, the qualification body shall:
a) be a legal entity, or form part of a legal entity;
b) have the financial stability and resources required for the operation of a qualification system
and adequate arrangements to cover liabilities arising from it;
c) safeguard impartiality and demonstrate true transparency and confidence in its qualification
activities;
d) be impartial and free from any commercial, financial and other pressures which might
influence the results of the qualification process;
e) have a qualification committee with the task of awarding, rejecting, maintaining, modifying,
suspending or cancelling a qualification certificate. Its members shall be competent. They are
chosen to safeguard impartiality and enable equal participation of the parties concerned,
regarding the contents and functioning of the qualification procedure, without any single
interest predominating. Clients and electrical installation contractors shall be equally
represented;
f) have a senior executive responsible for day-to-day operations in such a way as to be free
from pressures which could unfairly influence the outcome of the qualification process;
g) establish a clear separation of tasks if the qualification personnel are also charged with
activities other than qualification (including organisational identification and reporting
methods within the qualification body);
h) have an independent appeal committee to whom the appellant can address complaints. Its
members are chosen to safeguard impartiality and enable equal participation of the parties
concerned according to the rules set out under e) for the qualification committee.
4.3.3 No person having a self interest in the outcome of a specific qualification procedure/appeal may
participate in the decision making process.
4.4 Organisational structure
4.4.1 The qualification body shall have and make available on request:
a) a description of the legal status of the qualification body;
b) its annual financial accounts;
c) documented procedures describing the operation of the system, including the relationship
between the function of assessment, and issuing of the certificate as well as the rules of the
qualification, modifications, renewal, suspension, cancellation and appeal procedures;
d) names, qualifications, experience and terms of reference of the senior executive, with a
description of all his other tasks and of the other qualification personnel;
e) an organisation chart showing lines of authority, responsibility and allocation of functions
within the qualification body.
4.4.2 The qualification body shall have and make available to applicants and those possessing a
current qualification certificate:
a) general information about the qualification process and professional ethics imposed on the
qualification body;
b) information on the procedure to be followed, including time period needed for the completion
of the qualification process and fees charged;
c) the application forms to be completed;

d) a description of the rights and duties of applicants and qualified contractors, including
requirements, restrictions or limitations on the use of the qualification body’s logo and on the
ways of referring to the qualification granted;
e) a procedure to be applied in case of appeals.
4.4.3 The qualification body shall have documented procedures for conducting periodic internal reviews
covering all procedures in a planned and systematic manner, to verify its continuous compliance with the
provisions of this standard. The procedures shall ensure that:
a) personnel responsible for the area reviewed are informed of the outcome of the review;
b) corrective action, if necessary, is taken in a timely and appropriate manner;
c) the results of the review and the corrective action are recorded.
4.5 Qualification personnel
4.5.1 The personnel of the qualification body shall be competent for the functions they undertake.
Records of training and experience shall be maintained.
4.5.2 Personnel shall have available to them clearly documented instructions pertaining to their duties
and responsibilities. These instructions shall be maintained up-to-date.
4.5.3 A statement defining the professional ethics will be signed by the personnel of the qualification
body.
4.6 Use of external resources
4.6.1 The qualification body shall not use external resources for the performance of its tasks except for
the verification of the information presented by the applicant. Verification in that context might include to
check the completeness of the information supplied, but must not include any judgement whatsoever,
which could be relevant to the decision on the qualification.
4.6.2 The qualification body remains legally responsible for the services which are undertaken by the
external resources.
4.7 Documentation / Records
4.7.1 The qualification body shall maintain a system for the control of all documentation relating to the
qualification system.
4.7.2 The qualification body shall maintain a record system to suit its particular circumstances and to
comply with existing regulations. The record shall demonstrate that the qualification procedures have
been effectively fulfilled. The records shall be identified, managed and disposed of in such a way as to
ensure the integrity of the process and confidentiality of the information. The records shall be kept for an
adequate period of time so that continued confidence may be demonstrated for at least one full
qualification cycle, or as required by national legislation.
4.8 Access to documentation / Records
4.8.1 Upon request, every applicant/qualified contractor shall have access to all the
documentation/records pertaining to its application/qualification.
4.8.2 The qualification body shall have procedures concerning access to the records consistent with
confidentiality rules.
4.8.3 Upon request, the qualification body shall provide the applicant/qualified contractor with a copy of
their respective documentation/records. The related costs shall be reimbursed by the contractor.
4.9 Confidentiality
4.9.1 The qualification body shall have adequate arrangements, consistent with applicable laws, to
ensure confidentiality of the information obtained in the course of its qualification activities at all levels of
its organisation, including committees and external bodies. Any commercial use by the qualification body
of documents or related information provided by applicants/qualified contractors is forbidden.
4.9.2 Apart from the elements published in the publication referred to under 4.10, no other information
about a particular qualified contractor shall be disclosed to a third party without the written consent of the
contractor.
4.9.3 Except as required by law, information gained in the course of certification activities shall not be
disclosed to a third-party without the written consent of the contractor. Where the law requires information
to be disclosed to a third-party, the contractor shall be informed of the information provided as permitted
by the law.
4.9.4 No information about contractors for which the qualification process is not yet concluded shall be
disclosed, other than the fact that they are in the process of being addressed.
4.10 Publications
The qualification body shall publish in an official manner and update at least annually a list of the qualified
contractors with an outline of the scope of the qualification granted.
The information on qualified contractors is set out in 8.2.2.1 and 8.2.2.2.
4.11 Appeals
4.11.1 Appropriate procedures for appeals against decisions of the qualification body including inactivity
or refusal to start or to continue the qualification process shall be established. The applicant’s/qualified
contractor’s recourse to national/European courts is not excluded.
4.11.2 The qualification body shall:
a) keep a record of all appeals and remedial actions relative to qualification;
b) take appropriate corrective and preventive action;
c) document the actions taken and assess their effectiveness.
4.12 Misuse of documents
In the case of incorrect references to the qualification certificate, falsifications or any other misleading use
coming to the knowledge of the qualification body, it shall immediately intervene with suitable actions.
4.13 Recognition
4.13.1 A national competent body shall recognise a qualification body as competent and reliable to carry
out qualification according to this standard, if the qualification body complies with the procedures and the
criteria set out in Clauses 4 and 5 of this standard.
4.13.2 Where recognition is not directly established by national legislation, then the competent body
shall comply with the principles of independence and impartiality defined in this chapter.
4.13.3 Depending on the reasons for the cancellation, a review of the certificates awarded may be
necessary.

5 Application and assessment procedures
5.1 General
This Clause 5 specifies the application, assessment, review and appeal procedures to be followed for the
qualification of an electrical contractor.
5.2 Application procedure
5.2.1 Information for applicants
The qualification body shall have available upon request general informative and procedure documents,
as set out in 4.4.2.
5.2.2 Request of the application documents
The applicant shall address the qualification body in writing (including telefax, mail or e-mail), and request
the documents which are necessary to apply for qualification.
5.2.3 Supply of the application documents
Upon request, the qualification body shall send, within ten working days, the application documents (i.e.
the application form and further documents set out in Annex A) to the applicant.
5.2.4 Authorised signature
The application (see A.1) shall be signed by a person duly authorised to commit the applicant.
5.2.5 Registration of application
Upon receipt of the application, the qualification body shall immediately record the application in an
internal register.
5.2.6 Completeness of application
Upon receipt of the application, the qualification body shall check its completeness. If the application is
incomplete, the qualification body shall, within 20 working days from receipt of the application, ask for the
missing information/documentation required for qualification.
The qualification body may set out an adequate time limit for completion of the application. The time limit
shall be no shorter than 20 working days starting upon the applicant's receipt of the qualification body's
request. The applicant may ask for an extension.
If the applicant does not fulfil the request to complete the application within due time, the application is no
longer valid, except if the applicant can prove within that period that the delay for the presentation of the
missing documents or certificates is caused by a third party. All requests and responses shall be made by
verifiable means.
5.2.7 Attestation of correctness
If evidence of contradiction and/or incorrectness arises, the qualification body shall, without delay, ask the
applicant to produce due attestation of correctness by a nationally recognised authority/body. In such a
case paragraphs 2 and 3 of 5.2.6 apply.
5.3 Assessment procedure
5.3.1 Assessment period
The assessment period starts as soon as the qualification body has received a complete application. The
assessment period shall not exceed six months.
5.3.2 Recommendation for decision
The qualification body shall examine the application's conformity with the criteria set out in Clauses 6, 7
and 8 of this standard. The examination shall result in a recommendation for decision, which will be
submitted to the qualification committee.
5.3.3 Assessment of application
On the basis of the recommendation referred to in 5.3.2 the qualification committee shall, without delay,
investigate the application The applicant shall be informed of the decision (see B.3) after it has been
taken and implemented.
5.3.4 Award of certificate / rejection
If the application is approved, the qualification body shall issue the qualification certificate (see B.1) and
record the qualification in the qualification register within 5 working days.
If the application is rejected, the qualification body (see B.4) shall notify the applicant in writing of the
decision within 5 working days. The respective notification shall give the reasons for the decision and
inform the applicant about the appeal procedure.
A new application for the same section may be submitted to any qualification body, not earlier than six
months starting on the date of the rejection.
5.3.5 Authorisation of senior executive
The qualification committee may authorise the qualification body's senior executive to take decisions on
behalf of the qualification committee.
5.3.6 Certificate validity period
The qualification certificate, once issued, is subject to review of the documentation every three years. The
technical competence shall also be reviewed every three years. One month before expiry, the qualified
contractor shall send the documents allowing the qualification body to review qualification in accordance
with 5.4.1. Further reviews shall be carried out in accordance with 5.4.2 and 5.4.3.
The qualification continues to exist during the review procedure.
5.3.7 Probationary qualification
An applicant which is a start-up contractor, can ask for a probationary qualification if it meets:
a) the administrative and legal criteria, set out in Clause 6 of this standard, except for 6.5.3 and
6.5.4 during the financial year after having been established;
b) the financial criteria, as set out in Clause 7 of this standard;
c) the technical criteria as set out in Clause 8 of this standard, except for references for works
already completed (see 8.3.1).
If the applicant is already qualified in other areas, and still wishes to work in a particular section in order to
gain the necessary experience, only c) applies.

In any case the applicant will be qualified as "S", i.e. "start-up contractor", in the section(s) in which he
has decided to gain experience.
The time period for which a contractor can hold an "S" qualification shall not exceed two years unless
extended by a further one year if one satisfactory reference is provided, or if a contract is under
execution.
Contractors who fail to produce evidence of execution of work within the period defined above will lose
their "S" qualification and will become unqualified in the section concerned.
A period of one year must elapse before they can reapply for qualification.
5.4 Review procedure
5.4.1 General provisions
The qualification body will inform the qualified contractor, six months before the review of his qualification,
of the requirement for renewal of the assessment procedure. It shall invite the qualified contractor to
provide the relevant update or confirmation of the information contained in the application file.
In accordance with Clause 5 of this standard, the qualification body shall review the qualification and shall
hereby decide:
a) to maintain the qualification;
b) to extend or to restrict the scope of the qualification, if applicable;
c) to suspend the qualification;
d) to cancel the qualification.
The decision is taken by the qualification body, in accordance with the procedure set out in 5.2. and 5.3.
5.4.2 Change of relevant circumstances
Within the validity period of the certificate, the qualified contractor is obliged to notify (see B.2) the
qualification body within 20 working days, if:
a) the situation concerning 6.5.1, 6.5.57.3.2 and 8.3.3 changes;
b) it gives up electrical installation activities for which qualification has been granted;
c) it becomes bankrupt.
Upon notification of a) the qualification body shall review the qualification and take one of the decisions
referred to in 5.4.1.
Upon notification of b) and/or c), the qualification shall be cancelled.
5.4.3 Infringements relating to qualification
5.4.3.1 An application shall be rejected or a qualification be cancelled, if it can be proved that an
applicant/qualified contractor is guilty of one of the following infringements:
a) fraudulent behaviour during the qualification process;
b) false evidence concerning fulfilment of the qualification criteria;
c) falsification of the qualification certificate.
The cancellation shall be revoked after a period of three months following the removal from the qualified
contractor of the individual who has been proved guilty of the above mentioned infringements, provided
that incorrect information concerning the qualified contractor has been corrected. The cancellation and/or
the suspension of the qualification shall be recorded in the qualification register.
5.4.3.2 The qualification shall be suspended in the following two cases:
a) if the qualified contractor does not pay its subscription fees for qualification within three
months of invoice;
b) if the qualified contractor does not notify the change of relevant circumstances as provided in
5.4.2.
The suspension shall remain until such time as a) or b) no longer apply. The qualification shall be
cancelled if a) applies after a period of three months from the date of invoice.
The cancellation and/or the suspension of the qualification shall be recorded in the qualification register.
5.4.3.3 Following a written complaint from any contracting authority in contractual relationship with a
qualified enterprise which would not have respected its contractual obligations, the qualification can be
suspended or withdrawn.
In view of this, the qualification body shall organise a procedure of examination of the complaint.
Notwithstanding the respect of the contradictory character and equality of treatment of the enterprise, the
qualification body will make sure, by any means, of the reality of the facts. If it notices that the complaint
fits for acceptance and is founded on serious facts, it will be possible to suspend the qualification.
The enterprise will then have a period of one year to ask for the removal of the suspension by giving the
proof of the efficiency of the means used to palliate this or these malfunctions. Over this period the
qualification will be withdrawn.
The qualification is similarly withdrawn to an enterprise which for the same reasons, will have already
been subject to a measure of suspension during the period of validity of the qualification.
In case of a decision of suspension or withdrawal, the enterprise has a right of appeal as foreseen in 5.5.
For being able to receive again a qualification having been the subject of a withdrawal, the enterprise will
have to be subjected to the whole process of qualification after a one-year period.
5.5 Appeal procedure
The applicant/qualified contractor may appeal against any decision taken by the qualification body within
two months upon receipt of notification of the decision. The appeal shall give reasons and must be
submitted in writing to the appeal committee (see B.5).
Decisions which are unfavourable to the applicant/qualified contractor shall not take effect before the
appeal period of two months expires. If the applicant/qualified contractor appeals within this period, the
appeal automatically prolongs this period until the final decision of the appeal committee has been
notified to the applicant/qualified contractor.
The prolongation referred to in paragraph 2 does not apply to the rejection of an application or the charge
of fees for qualification.
The appeal committee shall take its decision within three months upon receipt of the appeal request. In
the case of an application for qualification, the decision shall be taken within two months. The appeal
committee's decision shall be given in writing and shall contain the reasons for the appeal committee's
final decision (see B.6) The applicant’s/qualified contractor's recourse to the ordinary courts is not
excluded.

6 Administrative and legal criteria for qualification
6.1 General
This Clause 6 specifies the administrative and legal identification data required for the purpose of
qualification (see 6.3), the administrative and legal criteria against which the applicant is assessed for the
purpose of qualification (see 6.4), and the documentation to be supplied by the applicant (see 6.5).
6.2 Eligibility for qualification
- All juridical forms and business enterprises officially recognised by the legislation of a
country are eligible to apply for qualification
- Two or more contractors acting as a joint venture or a consortium to carry out the electrical
works for which they are qualified are eligible to apply for qualification
- Groupings without juridical evidence are not eligible to apply for qualification
6.3 Administrative and legal identification data
The applicant shall provide the qualification body with the following information by completing the
application form A.2:
6.3.1 Name of the contractor for which qualification is sought

6.3.2 Address of the head office1 and of the office for administrative correspondence (if different)

6.3.3 Telephone, fax number(s) and e-mail address of the head office and of the office for
administrative correspondence (if different)
6.3.4 Legal status of the applicant and year it was founded
6.3.5 Professional or trade body registration number(s) (see C.1) in which the applicant is enrolled
6.3.6 VAT registration or national fiscal number, according to the legal provisions of the country(ies) in
which the applicant is established
6.3.7 Information concerning the legal representative(s):
a) full name;
b) business address, telephone number, telefax number and e-mail address;
c) position in the enterprise.
6.4 Administrative and legal assessment criteria
6.4.1 Criteria related to the applicant
6.4.1.1 An applicant shall:
a) not be bankrupt, or
b) not have suspended business activities, or
c) not be the subject of national insolvency proceedings (see C.2), or
d) not be in an analogous situation arising from national insolvency proceedings (see C.2).

6.4.1.2 Proof of legal standing
The applicant shall be enrolled in the professional or trade register, according to the legal provisions of
the country(ies) in which the applicant is established (see C.1).
6.4.1.3 Proof of payment of social security contributions
The applicant shall fulfil its obligations relating to the payment of social security contributions in
accordance with the legal provisions of the country(ies) in which the applicant is established.
6.4.1.4 Proof of payment of taxes
The applicant shall fulfil its obligations relating to the payment of taxes, according to the legal provisions
of the country(ies) in which the applicant is established.
6.4.2 Criteria relating to the legal representative(s) of the applicant
The application is rejected if the legal representative(s) of the applicant:
6.4.2.1 has during the last 5 years been convicted of an offence concerning his/her (their) professional
conduct by a judgement which has the force of “Res Judicata”. (A judgement or a decision has the force
of “Res Judicata”, if it cannot be changed by ordinary remedies according to European/National
legislation), or
6.4.2.2 is guilty of serious misrepresentation in supplying the information and/or documentation required
for qualification.
6.5 Documentation
The applicant shall provide the qualification body with the following documentation:
6.5.1 a copy of the certificate of a competent national authority about the right of the applicant to
perform electrical installations (trade licence, “Gewerbeschein”) and/or a copy or an extract of the
professional or trade register relating to the applicant confirming the applicant’s registration
number (see C.1). Any changes to this registration shall be notified to the qualification body in
accordance with 5.4.2;
6.5.2 a document issued by the competent National Authority stating that the applicant complies with
the criteria set out in 6.4.1.1;
6.5.3 a document of compliance with the payment of social security contributions, given by the social
security organisation of the country(ies) in which the applicant is established. The competent
organisations are listed in C.3;
6.5.4 a document of compliance with the payment of taxes, given by the competent authority of the
country(ies) in which the applicant is established. The competent authorities are listed in C.4;
6.5.5 a personal declaration by at least one legal representative(s) concerning the requirement of
6.4.2.1 relating to conviction of an offence which has the force of “Res Judicata”. Any changes
during the period of qualification shall be notified to the qualification body in accordance
with 5.4.2;
6.5.6 if the country in which the applicant is established does not issue the documents referred to in
6.5.2, 6.45.3 and 6.5.4, these documents shall be replaced by a declaration on oath or, in
countries where there is no provision for a declaration on oath, by a solemn declaration made by
the legal representative(s) of the applicant concerned before a judicial or administrative authority,
a notary or a competent professional or trade organisation;

6.5.7 in cases where the national laws do not foresee a declaration according to 6.4 and 6.5 issued by
authorities, a self-declaration by the contractor shall be sufficient.
6.6 Health, safety and electrical standards
Evidence should be provided of the existence of an organisation for health and safety in accordance with
EU legislation and relevant national health and safety legislation (see C. 3).
Evidence should be provided of the possession of certain European or national electrical standards (see
C.7 for the standards required for the various work sections).

Tehnična specifikacija SIST-TS CLC/TS 50349 (sl), Kvalifikacije izvajalcev električne napeljave, 2006, ima status slovenske tehnične specifikacije in je istovetna evropski tehnični specifikaciji CLC/TS 50349 (en), Qualification of electrical installation contractors, 2004.
NACIONALNI PREDGOVOR
Evropsko tehnično specifikacijo CLC/TS 50349:2004 je pripravil tehnični odbor Evropskega komiteja za standardizacijo v elektrotehniki CLC/TC 218 Kvalifikacije izvajalcev električne napeljave.
Slovenska tehnična specifikacija SIST-TS CLC/TS 50349 je prevod angleškega besedila CLC/TS 50349:2004. Slovensko izdajo je pripravil Strokovni svet SIST za področja elektrotehnike, informacijske tehnologije in telekomunikacij. V primeru spora glede besedila slovenskega prevoda je odločilen izvirni evropski standard v angleškem jeziku.
Odločitev za privzem te tehnične specifikacije je dne 15. julija 2006 sprejel Strokovni svet SIST za področja elektrotehnike, informacijske tehnologije in telekomunikacij.

To tehnično specifikacijo je CENELEC sprejel dne 24. aprila 2004.
Člani CENELEC morajo razglasiti obstoj te tehnične specifikacije enako kot za EN ter v ustrezni obliki zagotoviti njeno razpoložljivost na nacionalni ravni. Dovoljeno je, da veljajo tudi nacionalni standardi, ki so s to tehnično specifikacijo v nasprotju.

To tehnično specifikacijo je pripravil tehnični odbor CENELEC/TC 218 "Kvalifikacije izvajalcev električne inštalacije". Besedilo osnutka je bilo predloženo v formalno glasovanje in CENELEC ga je sprejel kot CLC/TS 50349 dne 24. aprila 2004.

Namen kvalifikacijskega sistema, opisanega v tej tehnični specifikaciji, je prepoznati usposobljenost izvajalca električnih inštalacij za delo, ki ga obravnava CENELEC in ki je v skladu z dejavnostmi iz
8-2-1. Ustreznim naročnikom omogoča razumeti profil izvajalca in predstavlja orodje, ki pomaga pri izbiri izvajalca v okviru posameznega razpisa. Ni namenjen za uporabo pri končnem izbirnem postopku za posamezne pogodbe, ki poteka po kvalifikacijskem postopku.

Ta tehnična specifikacija določa definicije, merila, postopke glede vloge in ocenjevanja ter tudi dokumentacijo, povezano s kvalifikacijskim sistemom za izvajalce električnih inštalacij.
Ta kvalifikacijski sistem vključuje dela na področju električnih inštalacij, vključno z dobavo opreme. Ta sistem ne zajema postopka proizvodnje te opreme.

3 Definicije
V tej tehnični specifikaciji veljajo naslednje definicije:
3.1 odbor za prizive odbor, ki je odgovoren za obravnavanje prizivov zoper odločitve in delovanje kvalifikacijskega organa
3.2 vložnik fizična(-e)/pravna(-e) oseba(-e) ne glede na svojo organizacijo, ki želi od kvalifikacijskega organa pridobiti certifikat o kvalifikaciji ali ga obdržati
3.3 obdobje veljavnosti certifikata obdobje, med katerim je certifikat o kvalifikaciji veljaven
3.4 pristojni organ nacionalni zasebni ali javni organ, ki priznava usposobljenost in zanesljivost kvalifikacijskega organa
3.5 izvajalec električnih inštalacij izvajalec, ki ima veščine in izkušnje za izvajanje del na področju električnih inštalacij s katerimi koli sredstvi
3.6 glavni izvajalec izvajalec, ki poleg izvajanja električarskih del, za kar je kvalificiran, koordinira druge kvalificirane izvajalce pri izvedbi dela projekta ali projekta v celoti
Glavni izvajalec mora dela oddajati samo izvajalcem, kvalificiranim na določenem področju dejavnosti.

4 Merila za kvalifikacijske organe
4.1 Splošno
Ta točka 4 določa merila, ki jih mora izpolnjevati kvalifikacijski organ, da bi bil priznan za dovolj usposobljenega in zanesljivega za vodenje kvalifikacijskega sistema za izvajalce električnih inštalacij. Določa tudi postopke, v skladu s katerimi se prizna kvalifikacijski organ.
4.2 Splošne zahteve
4.2.1 Kvalifikacijski organ mora vsem vložnikom omogočiti dostop do svojih storitev. Dostop ne sme biti pogojen z velikostjo vložnika ali njegovim članstvom v katerem koli združenju ali skupini ali s številom že kvalificiranih izvajalcev.
4.2.2 Postopke, v skladu s katerimi deluje kvalifikacijski organ, je treba uporabljati pregledno in nediskriminatorno. Kvalifikacijski organ mora vsem vložnikom zagotoviti enak dostop. Ne sme biti nobenih nepotrebnih finančnih ali drugih pogojev.

Upravna struktura 4.3.1 Upravna struktura kvalifikacijskega organa mora vzbujati zaupanje v njegove kvalifikacijske dejavnosti. 4.3.2 Kvalifikacijski organ mora zlasti: a) biti pravna oseba ali del pravne osebe; b) imeti potrebno finančno stabilnost in sredstva za delovanje kvalifikacijskega sistema ter ustrezno urejeno kritje obveznosti, ki izhajajo iz tega; c) zagotavljati nepristranskost in izkazovati pravo preglednost svojih kvalifikacijskih dejavnosti ter zaupanje vanje; d) biti nepristranski in brez vseh poslovnih, finančnih ali drugih pritiskov, ki bi lahko vplivali na rezultate kvalifikacijskega postopka;
SIST-TS CLC/TS 50349 : 2006 8 e) imeti kvalifikacijski odbor, ki je odgovoren za dodelitev, zavrnitev, ohranitev, spremembo in začasen odvzem ali preklic certifikata o kvalifikaciji. Člani odbora morajo biti usposobljeni. Njihova naloga je zagotavljati nepristranskost in enakopravno sodelovanje vpletenih strani na področju vsebine in delovanja kvalifikacijskega postopka brez prevlade posameznih interesov. V kvalifikacijskem odboru morajo biti enakomerno zastopani naročniki in izvajalci električnih inštalacij; f) imeti višjega vodstvenega delavca, ki je odgovoren za dnevno poslovanje in ne sme biti pod pritiski, ki bi lahko negativno vplivali na rezultate kvalifikacijskega postopka; g) vzpostaviti jasno razmejitev nalog, če kvalifikacijsko osebje opravlja tudi druge dejavnosti zunaj kvalifikacije (vključno z organizacijsko identifikacijo in metodami poročanja v kvalifikacijskem organu); h) imeti samostojen odbor za prizive, na katerega prizivnik naslovi pritožbo. Naloga članov odbora za prizive je zagotavljati nepristranskost in enakopravno sodelovanje vpletenih strani v skladu s pravili iz točke e) za kvalifikacijski odbor. 4.3.3 Pri postopku sprejemanja odločitve ne sme sodelovati nobena oseba, ki ima lasten interes glede rezultata določenega kvalifikacijskega postopka/priziva. 4.4 Organizacijska struktura 4.4.1 Kvalifikacijski organ mora imeti in na zahtevo dati na voljo: a) opis pravnega statusa kvalifikacijskega organa, b) svoja letna finančna poročila, c) dokumentirane postopke z opisom delovanja sistema, vključno z odnosom med funkcijo ocene, izdajo certifikata, pravili za kvalifikacijo, spremembami, obnovitvijo, začasnim odvzemom ali preklicem in prizivnimi postopki, d) imena, kvalifikacije, izkušnje in obseg pristojnosti višjega vodstvenega delavca z opisom vseh njegovih drugih nalog ter nalog drugega kvalifikacijskega osebja, e) organigram z linijami pooblastil, odgovornostjo in razdelitvijo funkcij v kvalifikacijskem organu. 4.4.2 Kvalifikacijski organ mora imeti ter dati na voljo vložnikom in imetnikom veljavnega certifikata o kvalifikaciji: a) splošne informacije o kvalifikacijskem postopku in poklicni etiki, ki jo mora spoštovati kvalifikacijski organ, b) informacije o uporabljenem postopku, vključno s časom, potrebnim za dokončanje kvalifikacijskega postopka, in zaračunanimi pristojbinami, c) obrazce vloge, ki jih je treba izpolniti, d) opis pravic in dolžnosti vložnikov in kvalificiranih izvajalcev, vključno z zahtevami in omejitvami glede uporabe logotipa kvalifikacijskega organa in načinov sklicevanja na odobrene kvalifikacije, e) prizivni postopek. 4.4.3 Kvalifikacijski organ mora imeti dokumentirane postopke za izvajanje rednih notranjih pregledov, ki načrtno in sistematično zajemajo vse postopke ter s katerimi se preveri, ali organ vedno upošteva določbe tega standarda. S postopki je treba zagotoviti: a) da je osebje, odgovorno za pregledano področje, obveščeno o rezultatih pregleda; b) da se po potrebi pravočasno in ustrezno izvedejo korektivni ukrepi; c) da se rezultati pregleda in korektivni ukrepi zabeležijo. 4.5 Kvalifikacijsko osebje 4.5.1 Osebje kvalifikacijskega organa mora biti usposobljeno za funkcije, ki jih opravlja. Vzdrževati je treba evidenco usposabljanj in izkušenj.
SIST-TS CLC/TS 50349 : 2006 9 4.5.2 Osebje mora imeti na voljo jasna navodila glede svojih dolžnosti in odgovornosti. Ta navodila je treba redno posodabljati. 4.5.3 Osebje kvalifikacijskega organa mora podpisati izjavo z opredelitvijo poklicne etike. 4.6 Uporaba zunanjih virov 4.6.1 Kvalifikacijski organ za izvajanje svojih nalog ne sme uporabljati zunanjih virov, razen za preverjanje informacij, ki jih je predložil vložnik. Preverjanje v tem okviru lahko vključuje pregled popolnosti predloženih informacij, ne sme pa vključevati kakršnih koli mnenj, ki bi lahko vplivala na odločitev o kvalifikaciji. 4.6.2 Kvalifikacijski organ je pravno odgovoren za storitve, ki jih izvajajo zunanji viri. 4.7 Dokumentacija/zapisi 4.7.1 Kvalifikacijski organ mora vzdrževati sistem za nadzor vse dokumentacije, povezane s kvalifikacijskim sistemom. 4.7.2 Kvalifikacijski organ mora vzdrževati sistem zapisov, ki ustreza njegovim okoliščinam in je v skladu z obstoječimi predpisi. Zapisi morajo dokazovati, da so bili kvalifikacijski postopki uspešno izvedeni. Zapise je treba identificirati, upravljati in uničiti tako, da se zagotovita celovitost postopka in zaupnost informacij. Zapise je treba hraniti tako dolgo, da se lahko dokaže trajno zaupanje v vsaj enem polnem kvalifikacijskem ciklusu, ali kot to zahteva nacionalna zakonodaja. 4.8 Dostop do dokumentacije/zapisov 4.8.1 Vsak vložnik/kvalificirani izvajalec mora na zahtevo imeti dostop do celotne dokumentacije/ zapisov v zvezi z njegovo vlogo/kvalifikacijo. 4.8.2 Postopki kvalifikacijskega organa glede dostopa do evidence morajo biti v skladu s pravili o zaupnosti. 4.8.3 Kvalifikacijski organ mora na zahtevo vložniku/kvalificiranemu izvajalcu zagotoviti kopijo te dokumentacije/zapisov. S tem povezane stroške mora kriti izvajalec. 4.9 Zaupnost 4.9.1 Kvalifikacijski organ mora za zagotavljanje zaupnosti informacij, pridobljenih med kvalifikacijskimi dejavnostmi na vseh ravneh svoje organizacije, vključno z odbori in zunanjimi organi, imeti ustrezne postopke, ki so v skladu z veljavno zakonodajo. Kvalifikacijskemu organu je prepovedana vsakršna komercialna uporaba dokumentov ali povezanih informacij, ki so jih predložili vložniki/kvalificirani izvajalci. 4.9.2 Razen elementov, objavljenih v publikaciji iz točke 4.10, se tretji osebi ne smejo razkriti nobene informacije o posameznem kvalificiranem izvajalcu brez pisnega dovoljenja tega izvajalca. 4.9.3 Informacije, pridobljene med certifikacijskimi dejavnostmi, se ne smejo razkriti tretji osebi brez pisnega dovoljenja izvajalca, razen če to zahteva zakon. Če zakon zahteva razkritje podatkov tretji osebi, je treba izvajalca obvestiti o informacijah, razkritih v skladu z zakonom. 4.9.4 O izvajalcih, katerih kvalifikacijski postopek še ni zaključen, se ne smejo razkriti nobene informacije, razen dejstva, da so v postopku obravnave. 4.10 Objave Kvalifikacijski organ mora uradno objaviti seznam kvalificiranih izvajalcev s povzetkom področja uporabe dodeljene kvalifikacije in ga posodobiti vsaj enkrat na leto. Informacije o kvalificiranih izvajalcih so določene v točkah 8.2.2.1 in 8.2.2.2.
SIST-TS CLC/TS 50349 : 2006 10 4.11 Prizivi 4.11.1 Vzpostaviti je treba ustrezne prizivne postopke zoper sklepe kvalifikacijskega organa, tudi glede neučinkovitosti ali zavrnitve začetka klasifikacijskega postopka ali njegovega nadaljevanja. Vložnik/kvalificirani izvajalec se lahko obrne tudi na nacionalna/evropska sodišča. 4.11.2 Kvalifikacijski organ mora: a) voditi evidenco vseh prizivov in odprav pomanjkljivosti v zvezi s kvalifikacijo; b) sprejeti ustrezne korektivne in preventivne ukrepe; c) dokumentirati sprejete ukrepe in oceniti njihovo uspešnost. 4.12 Nepravilna uporaba dokumentov Če kvalifikacijski organ ugotovi nepravilno sklicevanje na certifikat o kvalifikaciji, njegovo ponarejanje ali kakršno koli drugo zavajajočo uporabo, mora takoj ustrezno ukrepati. 4.13 Priznavanje 4.13.1 Nacionalni pristojni organ prizna kvalifikacijski organ kot dovolj usposobljen in zanesljiv za izvedbo kvalifikacije v skladu s tem standardom, če kvalifikacijski organ ustreza postopkom in merilom iz točk 4 in 5 tega standarda. 4.13.2 Če priznanje ni neposredno določeno z nacionalno zakonodajo, mora pristojni organ ravnati v skladu z načeloma samostojnosti in nepristranskosti iz tega poglavja. 4.13.3 Odvisno od razlogov za preklic bo morda potreben pregled dodeljenih certifikatov. 5 Postopki glede vloge in ocenjevanja 5.1 Splošno Ta točka 5 določa postopke glede vloge, ocene, pregleda in prizivov, ki se uporabljajo za kvalifikacijo izvajalca na področju elektrike. 5.2 Postopek glede vloge 5.2.1 Informacije za vložnike Kvalifikacijski organ mora na zahtevo imeti na voljo splošne informativne dokumente in dokumente v zvezi s postopki, kot je določeno v točki 4.4.2. 5.2.2 Zahteva za dokumente v zvezi z vlogo Vložnik mora na kvalifikacijski organ nasloviti pisno (po telefaksu, pošti ali elektronski pošti) zahtevo za dokumente, potrebne za vlogo za kvalifikacijo. 5.2.3 Pošiljanje dokumentov v zvezi z vlogo Kvalifikacijski organ mora na zahtevo v roku deset delovnih dni poslati vložniku dokumente v zvezi z vlogo (tj. obrazce za vlogo in dodatne dokumente iz dodatka A). 5.2.4 Podpis pooblaščenca Vlogo (glej A.1) mora podpisati oseba, ki je ustrezno pooblaščena za potrditev vložnika. 5.2.5 Registracija vloge Kvalifikacijski organ mora vlogo ob prejemu takoj vnesti v notranji register.
SIST-TS CLC/TS 50349 : 2006 11 5.2.6 Popolnost vloge Kvalifikacijski organ mora ob prejemu vloge preveriti, ali je popolna. V primeru nepopolne vloge mora kvalifikacijski organ v roku 20 delovnih dni od njenega prejema zahtevati manjkajoče informacije/dokumentacijo, ki je potrebna za kvalifikacijo. Kvalifikacijski organ lahko določi ustrezen rok za dopolnitev vloge. Rok ne sme biti krajši od 20 delovnih dni od dne, ko je vložnik prejel zahtevo kvalifikacijskega organa. Vložnik lahko zaprosi za podaljšanje roka. Če vložnik ne izpolni zahteve za dopolnitev vloge pravočasno, vloga ni več veljavna, razen če lahko vložnik v tem obdobju dokaže, da je zamudo pri predložitvi manjkajočih dokumentov ali certifikatov povzročila tretja oseba. Vse zahteve in odgovore je treba izvesti s preverljivimi sredstvi. 5.2.7 Potrdilo o pravilnosti Če se pojavijo znaki nasprotij in/ali nepravilnosti, mora kvalifikacijski organ takoj zahtevati od vložnika, da predloži ustrezno potrdilo o pravilnosti nacionalno priznane službe/organa. V takem primeru veljata drugi in tretji odstavek točke 5.2.6. 5.3 Postopek ocenjevanja 5.3.1 Obdobje ocenjevanja Obdobje ocenjevanja se začne takoj, ko kvalifikacijski organ prejme popolno vlogo. Obdobje ocenjevanja ne sme biti daljše od šest mesecev. 5.3.2 Priporočilo za odločitev Kvalifikacijski organ mora preučiti, ali vložnik ustreza merilom iz točk 6, 7 in 8 tega standarda. Po preučevanju mora oblikovati priporočilo za odločitev, ki se predloži kvalifikacijskemu odboru. 5.3.3 Ocenjevanje vloge Kvalifikacijski odbor mora na podlagi priporočila iz točke 5.3.2 takoj preučiti vlogo. Po sprejetju odločitve in njeni izvršitvi se o njej obvesti vložnik (glej B.3). 5.3.4 Dodelitev certifikata/zavrnitev Kvalifikacijski organ mora v primeru odobritve vloge izdati certifikat o kvalifikaciji (glej B.1) in v petih delovnih dneh kvalifikacijo vnesti v register kvalifikacij. Kvalifikacijski organ (glej B.4) mora v primeru zavrnitve vloge pisno obvestiti vložnika o odločitvi v petih delovnih dneh. V obvestilu je treba navesti razloge za odločitev in informacije o prizivnem postopku. Nova vloga za isto področje se lahko predloži kateremu koli kvalifikacijskemu organu, vendar ne prej kot šest mesecev od datuma zavrnitve. 5.3.5 Pooblastilo višjega vodstvenega delavca Kvalifikacijski odbor lahko pooblasti svojega višjega vodstvenega delavca za sprejemanje odločitev v imenu kvalifikacijskega odbora. 5.3.6 Čas veljavnosti certifikata Po izdaji certifikata o kvalifikaciji je treba dokumentacijo pregledati vsaka tri leta. Tudi tehnično usposobljenost je treba pregledati vsaka tri leta. Kvalificirani izvajalec mora en mesec pred prenehanjem veljavnosti certifikata poslati kvalifikacijskemu organu dokumente, ki omogočajo pregled kvalifikacije v skladu s točko 5.4.1. Nadaljnje preglede je treba izvesti v skladu s točkama 5.4.2 in 5.4.3.
SIST-TS CLC/TS 50349 : 2006 12 Med postopkom pregleda je kvalifikacija veljavna. 5.3.7 Poskusna kvalifikacija Vložnik, ki začenja z zagotavljanjem svojih storitev, lahko zaprosi za poskusno kvalifikacijo, če izpolnjuje: a) upravna in pravna merila iz točke 6 tega standarda, razen 6.5.3 in 6.5.4, v poslovnem letu po ustanovitvi, b) finančna merila iz točke 7 tega standarda; c) tehnična merila iz točke 8 tega standarda, razen referenc za dokončana dela (glej 8.3.1). Če je vložnik že kvalificiran na drugih področjih in še vedno želi delati na določenem področju, da bi pridobil potrebne izkušnje, velja le točka c). V vsakem primeru bo vložnik kvalificiran kot "S", tj. "izvajalec, ki začenja z izvajanjem svojih storitev", na področju(-ih), na katerem(-ih) želi pridobiti izkušnje. Časovno obdobje, v katerem je izvajalec lahko kvalificiran kot "S", ne sme biti daljše od dveh let, razen če se po predložitvi zadovoljive reference podaljša za dodatno leto ali je v teku izvajanje pogodbe. Izvajalci, ki ne morejo predložiti dokazov, da so v zgoraj določenem obdobju izvajali delo, bodo izgubili kvalifikacijo "S" in na zadevnem področju ne bodo več kvalificirani. Pred ponovno oddajo vloge za kvalifikacijo mora preteči eno leto. 5.4 Postopek pregleda 5.4.1 Splošne določbe Kvalifikacijski organ bo o zahtevi za obnovitev postopka ocenjevanja obvestil kvalificiranega izvajalca šest mesecev pred pregledom njegove kvalifikacije. Kvalificiranega izvajalca mora pozvati k ustrezni posodobitvi ali potrditvi informacij iz vloge. Kvalifikacijski organ mora v skladu s točko 5 tega standarda pregledati kvalifikacijo in odločiti, ali bo: a) obnovil kvalifikacijo; b) razširil ali skrčil področje uporabe kvalifikacije, če je to primerno; c) začasno odvzel kvalifikacijo; d) preklical kvalifikacijo. Odločitev sprejme kvalifikacijski organ v skladu s postopkom iz točk 5.2. in 5.3. 5.4.2 Sprememba ustreznih okoliščin V času veljavnosti certifikata mora kvalificirani izvajalec v 20 delovnih dneh obvestiti (glej B.2) kvalifikacijski organ, če: a) se spremenijo razmere glede točk 6.5.1, 6.5.5, 7.3.2 in 8.3.3; b) preneha izvajati dejavnosti na področju električnih inštalacij, za katere je bila kvalifikacija podeljena; c) gre v stečaj. Kvalifikacijski organ mora na podlagi obvestila iz točke a) pregledati kvalifikacijo in sprejeti eno od odločitev iz točke 5.4.1. Na podlagi obvestila iz točk b) in/ali c) je treba kvalifikacijo preklicati.
SIST-TS CLC/TS 50349 : 2006 13 5.4.3 Kršitve v zvezi s kvalifikacijo 5.4.3.1 Vlogo je treba zavrniti ali kvalifikacijo preklicati, če se lahko dokaže, da je vložnik/kvalificirani izvajalec storil eno od naslednjih kršitev: a) goljufivo vedenje med kvalifikacijskim postopkom, b) lažni dokazi glede izpolnjevanja kvalifikacijskih meril, c) ponarejanje certifikata o kvalifikaciji. Razveljavitev je treba preklicati po preteku treh mesecev potem, ko je kvalificirani izvajalec odstranil posameznika, ki je kriv za navedene kršitve, če so bile nepravilne informacije glede kvalificiranega izvajalca popravljene. Preklic in/ali začasni odvzem kvalifikacije je treba vnesti v register kvalifikacij. 5.4.3.2 Kvalifikacijo je treba začasno odvzeti, če: a) kvalificirani izvajalec ne plača pristojbin za kvalifikacijo v treh mesecih po prejemu računa, b) kvalificirani izvajalec ne obvesti kvalifikacijskega organa o spremembi ustreznih okoliščin iz točke 5.4.2. Začasni odvzem mora trajati, dokler točka a) ali b) ne velja več. Kvalifikacijo je treba preklicati, če a) velja po obdobju treh mesecev od dneva izstavitve računa. Preklic in/ali začasni odvzem kvalifikacije je treba vnesti v register kvalifikacij. 5.4.3.3 Kvalifikacijo je mogoče začasno odvzeti ali preklicati po pisni pritožbi katerega koli naročnika v pogodbenem razmerju s kvalificiranim podjetjem, ki ni spoštovalo pogodbenih obveznosti. V skladu s tem mora kvalifikacijski organ organizirati postopek za preučitev pritožbe.
Ne glede na upoštevanje nasprotujočega značaja in enakega obravnavanja podjetja bo kvalifikacijski organ z vsemi sredstvi preveril resničnost dejstev. Če ugotovi, da je pritožba sprejemljiva in temelji na resnih dejstvih, bo mogoče začasno odvzel kvalifikacijo. Podjetje bo nato lahko v enem letu zaprosilo za ukinitev začasnega odvzema, pri čemer bo moralo predložiti dokaze o uspešnosti sredstev, uporabljenih za njegovo ublažitev ali ublažitev teh napak. Po preteku tega obdobja bo kvalifikacija preklicana. Prav tako se prekliče kvalifikacija podjetja, ki je bilo iz istih razlogov že predmet začasnega odvzema v času veljavnosti kvalifikacije. Podjetje ima v primeru odločitve o začasnem odvzemu ali preklicu pravico do priziva, kot je to predvideno v točki 5.5.
Za ponovno pridobitev kvalifikacije bo moralo podjetje potem, ko je bilo predmet preklica, po enem letu ponoviti celoten kvalifikacijski postopek. 5.5 Prizivni postopek Vložnik/kvalificirani izvajalec se lahko zoper vsako odločitev kvalifikacijskega organa pritoži v dveh mesecih od prejema obvestila o odločitvi. Priziv mora biti utemeljen in pisno predložen odboru za prizive (glej B.5). Odločitve, ki so za vložnika/kvalificiranega izvajalca neugodne, ne smejo stopiti v veljavo pred iztekom dvomesečnega roka za priziv. Če vložnik/kvalificirani izvajalec v tem roku vloži priziv, se rok zaradi priziva avtomatično podaljša, dokler vložnik/kvalificirani izvajalec ni obveščen o končni odločitvi odbora za prizive. Podaljšanje iz drugega odstavka ne velja za zavrnitev vloge ali zaračunane pristojbine za kvalifikacijo.
SIST-TS CLC/TS 50349 : 2006 14 Odbor za prizive sprejme odločitev v treh mesecih od prejema priziva. V primeru vloge za kvalifikacijo je treba odločitev sprejeti v dveh mesecih. Odločitev odbora za prizive mora biti pisna in mora vsebovati razloge za končno odločitev (glej B.6). Vložnik/kvalificirani izvajalec se lahko obrne tudi na redna sodišča. 6 Upravna in pravna merila za kvalifikacijo 6.1 Splošno Ta točka 6 določa upravne in pravne identifikacijske podatke, ki se zahtevajo za kvalifikacijo (glej 6.3), administrativna in pravna merila, v skladu s katerimi se ocenjuje ustreznost vložnika za kvalifikacijo (glej 6.4), in dokumentacijo, ki jo mora vložnik predložiti (glej 6.5). 6.2 Upravičenost do kvalifikacije – Do vloge za kvalifikacijo so upravičene vse pravne oblike in podjetja, ki so uradno priznani v državni zakonodaji. – Do vloge za kvalifikacijo sta upravičena dva izvajalca ali več, ki kot skupno podjetje ali konzorcij izvajajo električna dela, za katera so kvalificirani. – Združenja brez pravnih dokazil niso upravičena do vloge za kvalifikacijo. 6.3 Upravni in pravni identifikacijski podatki Vložnik mora v izpolnjenem obrazcu A.2 predložiti kvalifikacijskemu organu naslednje informacije: 6.3.1 Ime izvajalca, ki želi pridobiti kvalifikacijo. 6.3.2 Naslov sedeža podjetja1) in pisarne za upravno korespondenco (če se razlikujeta). 6.3.3 Telefonsko(-e) številko(-e), številko(-e) telefaksa in elektronski naslov sedeža podjetja1) ter pisarne za upravno korespondenco (če se razlikujejo). 6.3.4 Pravni status vložnika in leto njegove ustanovitve. 6.3.5 Registrsko(-e) številko(-e) organa poklicnih ali gospodarskih subjektov (glej C.1), v katerega je vložnik vpisan. 6.3.6 Identifikacijska številka za DDV ali nacionalna davčna številka v skladu s predpisi v državi(-ah), v kateri(-ih) je vložnik ustanovljen. 6.3.7 Informacije o pravnih zastopnikih: a) polno ime, b) poslovni naslov, telefonska številka, številka telefaksa in elektronski naslov, c) položaj v podjetju. 6.4 Upravna in pravna merila za ocenjevanje 6.4.1 Merila glede vložnika 6.4.1.1 Vložnik ne sme: a) biti v stečaju ali b) imeti začasno preklicanih poslovnih dejavnosti, c) biti v nacionalnem insolvenčnem postopku (glej C.2), d) biti v enakovrednem položaju, ki izhaja iz insolvenčnega postopka (glej C.2).

SIST-TS CLC/TS 50349 : 2006 15 6.4.1.2 Dokazilo zakonitosti Vložnik mora biti vpisan v register poklicnih ali gospodarskih subjektov v skladu s predpisi v državi(-ah), v kateri(-ih) je vložnik ustanovljen (glej C. 1). 6.4.1.3 Dokazilo o plačilu prispevkov za socialno varnost Vložnik mora izpolniti svoje obveznosti v zvezi s plačilom prispevkov za socialno varnost v skladu s predpisi v državi(-ah), v kateri(-ih) je vložnik ustanovljen. 6.4.1.4 Dokazilo o plačilu davkov Vložnik mora izpolniti svoje obveznosti v zvezi s plačilom davkov v skladu s predpisi v državi(-ah), v kateri(-ih) je vložnik ustanovljen. 6.4.2 Merila glede pravnega(-ih) zastopnika(-ov) vložnika Vloga se zavrne, če je (so) bil(-i) pravni zastopnik(-i) vložnika: 6.4.2.1 v zadnjih petih letih pravnomočno obsojen(-i) zaradi kaznivega dejanja med njegovim (njihovim) poklicnim ravnanjem (sodba ali odločitev je pravnomočna, če je ni mogoče spremeniti z običajnimi sredstvi v skladu z evropsko/nacionalno zakonodajo); 6.4.2.2 je (so) kriv(-i) napačnega prikazovanja informacij in/ali dokumentacije, ki se zahteva za kvalifikacijo. 6.5 Dokumentacija Vložnik mora predložiti kvalifikacijskemu organu naslednjo dokumentacijo: 6.5.1 kopijo certifikata pristojnega nacionalnega organa o vložnikovih pravicah do izvajanja električnih inštalacij (dovoljenje za opravljanje dejavnosti, "Gewerbeschein") in/ali kopijo ali izpisek iz registra poklicnih ali gospodarskih subjektov, ki se nanaša na vložnika in potrjuje njegovo registrsko številko (glej C.1). Kvalifikacijski organ je treba v skladu s točko 5.4.2 obvestiti o vseh spremembah te registracije, 6.5.2 dokument pristojnega nacionalnega organa, v katerem je navedeno, da vložnik ustreza merilom iz točke 6.4.1.1, 6.5.3 dokument, ki izkazuje plačilo prispevkov za socialno varnost in ga je izdala organizacija za socialno varnost države (držav), v kateri(-ih) je vložnik ustanovljen. Pristojne organizacije so navedene v točki C.3, 6.5.4 dokument, ki izkazuje plačilo davkov in ga je izdal pristojni organ države (držav), v kateri(-ih) je vložnik ustanovljen. Pristojni organi so navedeni v C.4, 6.5.5 osebno izjavo vsaj enega pravnega zastopnika o zahtevi iz točke 6.4.2.1 v zvezi s pravnomočno obsodbo. Kvalifikacijski organ je treba v skladu s točko 5.4.2 obvestiti o vseh spremembah v času veljavnosti kvalifikacije, 6.5.6 če država, v kateri je vložnik ustanovljen, ne izdaja dokumentov iz točk 6.5.2, 6.5.3 in 6.5.4, je treba te dokumente nadomestiti z izjavo pod prisego, ali v državah, kjer izjava pod prisego ni predvidena, s slovesno izjavo, ki jo pravni zastopnik(-i) zadevnega vložnika da(-jo) pred sodnim ali upravnim organom, notarjem ali pristojno organizacijo poklicnih ali gospodarskih subjektov, 6.5.7 kadar nacionalni zakoni ne predvidevajo izjave organov iz točk 6.4 in 6.5, zadostuje lastna izjava izvajalca.
