2019/2024 - COMMISSION REGULATION (EU) 2019/2024 of 1 October 2019 laying down ecodesign requirements for refrigerating appliances with a direct sales function pursuant to Directive 2009/125/EC of the European Parliament and of the Council Harmonized Directive
Commission Regulation (EU) 2019/2024 establishes ecodesign requirements for electric mains-operated refrigerating appliances with a direct sales function, including supermarket cabinets, beverage coolers, ice-cream freezers, gelato cabinets, and refrigerated vending machines. The regulation aims to reduce energy consumption and environmental impact during use, targeting annual energy savings estimated at 48 TWh by 2030. It applies to appliances designed for displaying and selling foodstuffs and other items at temperatures below ambient temperature, accessible to customers. The regulation excludes appliances powered by non-electric energy sources, remote components, professional refrigerated storage, wine storage appliances, and minibars, among others. Energy efficiency requirements are set based on appliance functionality to drive market preference towards more efficient products. The regulation also requires manufacturers to provide technical documentation and prohibits performance manipulation during testing. Measurement and conformity assessment procedures align with recognized standards. The regulation supports circular economy objectives by facilitating reuse, dismantling, and recovery, with a review planned to evaluate effectiveness in achieving environmental goals.
Purpose
Commission Regulation (EU) 2019/2024 establishes ecodesign requirements for electric mains-operated refrigerating appliances with a direct sales function. The regulation aims to reduce the environmental impact of these products by improving their energy efficiency during the use phase, without incurring excessive costs. It supports the broader EU objectives of energy savings and greenhouse gas emission reduction, contributing to the ecodesign framework under Directive 2009/125/EC and the EU’s Circular Economy Action Plan. The regulation addresses significant environmental impacts, primarily focusing on energy consumption, while also considering direct refrigerant emissions and product reparability.
Key obligations
- Ecodesign Requirements: Refrigerating appliances with a direct sales function must meet minimum energy efficiency criteria based on the appliance’s functionality. These requirements are detailed in Annex II of the Regulation and apply from specified dates.
- Energy Efficiency Index (EEI): Manufacturers are required to calculate and declare an Energy Efficiency Index for their products, reflecting their relative energy performance.
- Conformity Assessment: Manufacturers, importers, or authorized representatives must conduct conformity assessments in line with Directive 2009/125/EC using either the internal design control system (Annex IV) or a management system (Annex V).
- Technical Documentation: Relevant technical data including product information must be compiled as part of the conformity assessment and be accessible for market surveillance.
- Prohibition of Performance Manipulation: Products that alter their performance during testing to improve declared parameters (e.g., "test mode" improvements) are prohibited.
- Facilitation of Circular Economy: Products should be designed to facilitate reuse, dismantling, and recovery of materials, in line with Directive 2012/19/EU on waste electrical and electronic equipment (WEEE).
- Measurement Methods: Product testing must use reliable, accurate, and reproducible methods, incorporating recognized standards and harmonized European standards where applicable.
- Market Surveillance and Product Database: Manufacturers may refer to the EU product database for compliance purposes, providing transparency and accessibility of product information.
Affected products and actors
- Scope of Products: This Regulation applies to supermarket refrigerating cabinets, beverage coolers, ice-cream freezers, gelato-scooping cabinets, and refrigerated vending machines with a direct sales function, which are electric mains-operated.
- Excluded Products: The Regulation excludes:
- Refrigerating appliances powered solely by non-electric energy sources.
- Remote components (e.g., condensing units, compressors).
- Food processing appliances (e.g., ice-cream makers).
- Appliances approved for storing medicines or scientific samples.
- Appliances without integrated cooling systems but using chilled air from external units.
- Professional refrigerated storage cabinets, blast cabinets, condensing units, process chillers.
- Wine storage appliances and minibars covered by separate regulations.
- Certain specialized appliance categories such as saladettes, horizontal serve-over counters, corner cabinets, vending machines operating at frozen temperatures, and fish counters with flaked ice.
- Actors Responsible: Manufacturers, importers, authorized representatives, and economic operators placing these products on the EU market must ensure compliance with the ecodesign requirements and conformity assessment procedures.
Implementation timeline
- The ecodesign requirements described in Annex II apply from the dates specified within the annex itself. These timelines ensure a gradual phase-in allowing stakeholders to adapt.
- A mandatory review of the Regulation will be conducted after implementation to assess its effectiveness and relevance, allowing for updates or amendments if necessary.
This Regulation plays a crucial role in improving the energy efficiency of direct-sales refrigerating appliances in the EU market, thereby contributing to energy savings, emission reductions, and supporting the transition to a circular economy.
This regulation establishes ecodesign requirements for electric mains-operated refrigerating appliances with a direct sales function, including appliances used to refrigerate items other than foodstuffs. It applies specifically to supermarket refrigerating cabinets (freezer or refrigerator), beverage coolers, ice-cream freezers, gelato-scooping cabinets, and refrigerated vending machines. The scope excludes non-electric refrigerating appliances, remote components like condensing units or compressors, food processing refrigerating appliances, appliances specifically tested and approved for medicines or scientific samples, appliances without integrated cooling systems that use ducted chilled air, professional refrigerated storage cabinets and related equipment, as well as wine storage appliances and minibars. Certain types of products such as refrigerated aquaria, saladettes, horizontal serve-over counters with integrated storage, corner cabinets, frozen vending machines, and serve-over fish counters with flaked ice are also exempted. Frequently Asked Questions
An EU Regulation is a binding legislative act that must be applied in its entirety across the European Union. Unlike directives, regulations do not need to be transposed into national law and are directly applicable in all member states. Regulations are used when uniform application across all EU countries is essential.
Regulation 2019/2024 covers "COMMISSION REGULATION (EU) 2019/2024 of 1 October 2019 laying down ecodesign requirements for refrigerating appliances with a direct sales function pursuant to Directive 2009/125/EC of the European Parliament and of the Council". This legislation has harmonized European standards (hENs) that provide a presumption of conformity with its essential requirements. There are 14 standards associated with this regulation.
Harmonized standards under 2019/2024 are European standards (ENs) developed by CEN, CENELEC, or ETSI in response to a mandate from the European Commission. When these standards are cited in the Official Journal of the European Union, products manufactured in conformity with them benefit from a presumption of conformity with the essential requirements of 2019/2024, facilitating CE marking and free movement within the European Economic Area.
